Idaho TreeSmiths LLC

Terms & Conditions

Last updated September 27, 2026

These Terms and Conditions apply to every quote Idaho TreeSmiths LLC provides and become part of our agreement when a quote is accepted. Our cancellation policy is in Section 11, and our refund policy is in Section 12.

1. Acceptance and Scope

By selecting "Accept" electronically or signing a printed copy of this quote, the customer named on the quote ("Customer") approves the scope of work, total price, and these Terms and Conditions from Idaho TreeSmiths LLC ("we," "us"). Only the work specifically described in this quote is included. Unless the quote says otherwise, cleanup and removal of all resulting debris, wood, and chips is included.

2. Payment

Payment is due on receipt of our invoice, which we will provide on the day the work is completed, in person, by email, or by text. We accept cash and credit or debit cards. If the Customer disputes part of the work in good faith, all undisputed amounts must still be paid when due. Balances unpaid 30 days after the invoice date are subject to a late fee of 1% per month, or the maximum permitted by Idaho law, if less.

3. Changes and Unforeseen Conditions

Any change to the scope of work or total price must be approved by the Customer before additional work is performed. Approval may be given in writing, by email, or by text. If the crew finds a condition that was not reasonably visible when the quote was prepared, such as hidden rot, structural hazards, or blocked access, we may pause work and provide a revised scope and price. If the Customer does not approve the change, we may complete only the portion of the original scope that can be done safely, or stop work, and the Customer is responsible for the work performed up to that point. If a condition creates an immediate safety risk, we may take reasonable steps to make the site safe and will notify the Customer promptly.

4. Authority and Access

The Customer confirms that the trees and property are owned by the Customer, or that the Customer has all permissions necessary to authorize the work. The Customer authorizes us to access the property with the crew, vehicles, and equipment reasonably needed to perform the work safely.

5. Work-Area Preparation

Before work begins, the Customer will remove or identify vehicles, furniture, decorations, toys, fragile items, pet waste, and other movable property from the work and access areas, and will ensure gates are unlocked and access routes are clear. For everyone’s safety, the Customer will keep children, pets, visitors, and others well outside the work area while work is underway. We are not responsible for damage to movable items that were not removed or disclosed before work began, except as provided in Section 15. If the crew cannot begin work because the area is not ready, access is blocked, or the Customer or a representative is unavailable when needed, we may reschedule and add a $50 trip fee to the invoice.

6. Property and Lawn Conditions

The Customer will disclose known conditions that could affect safe access or equipment use, such as soft or saturated ground, septic systems, drainage areas, or recently installed landscaping. Tree work requires vehicles, equipment, and the movement of heavy logs, limbs, and debris. Even with Reasonable Care (defined in Section 15), this may cause normal surface effects such as compressed grass, tire impressions, minor ruts, disturbed mulch, or limited soil displacement. We are not responsible for these normal and reasonably anticipated effects, but this does not apply to damage caused by our failure to use Reasonable Care. Unless included in the quote, lawn repair, reseeding, grading, irrigation repair, and other property restoration are not included in the price.

7. Underground Utilities and Concealed Features

When the work involves excavation, stump grinding, or other ground penetration, we will make any utility-location notifications required by law. The Customer is responsible for identifying and clearly marking, or arranging for the marking of, all private underground systems and concealed features not identified through the public utility-location process, including irrigation lines and sprinkler heads, invisible dog fencing, landscape lighting, septic and drainage systems, private utility lines, cables, pipes, and edging. Because these items are often shallow, the Customer should mark them before any stump grinding. On request, we will do a pre-work walkthrough to review marked items. We are not responsible for damage to an underground or concealed item that was not disclosed and reasonably marked before work began, unless caused by our failure to use Reasonable Care.

8. Tree Condition and Outcomes

Trees may have internal decay, root problems, disease, or structural weaknesses that are not visible on inspection. Tree work, including pruning, cannot guarantee a tree’s health, survival, or future stability, or eliminate the risk of failure, particularly for trees that are already compromised. We will perform the approved work using Reasonable Care, but we do not warrant the future condition of any tree.

9. HOA Approvals, Permits, and Property Lines

The Customer is responsible for obtaining any homeowners’ association approvals needed for the work and for telling us before work begins if the tree is in a public right-of-way, a historic district, or another protected area. Unless the quote says otherwise, we will obtain any city or county permit required, and any permit fee will be listed on the quote. The Customer is responsible for identifying property lines and for any disagreement with a neighbor over ownership of a tree or boundary.

10. Scheduling

After this quote is approved, we will contact the Customer with available work dates and approximate arrival times and schedule the work together. Dates and times may change because of weather, unsafe site conditions, equipment availability, delays on earlier jobs, or other circumstances affecting safe operations. We will notify the Customer as soon as reasonably possible if work must be delayed or rescheduled.

11. Cancellation

These cancellation terms begin once the Customer has accepted a quote. Different rules apply during the cooling-off period, after it ends, and once work begins, as described below.

Cooling-off period. For transactions covered by applicable cooling-off laws, the Customer may cancel without penalty or obligation at any time before midnight of the third business day after accepting this quote online or signing a printed copy. Saturday is a business day; Sundays and federal holidays are not. To cancel, notify us in writing by email at office@idahotreesmiths.com or by mail at Idaho TreeSmiths LLC, PO Box 4693, Boise, ID 83711. Notice is timely if emailed or postmarked by the deadline. We will refund any payment within 10 business days. Where a cooling-off law applies, we will provide a Notice of Cancellation form and will not begin work before the period ends unless the law permits us to at the Customer’s written request.

After the cooling-off period. Once the cooling-off period above has ended, the Customer may cancel scheduled work without charge by giving notice at least 24 hours before the scheduled start time, by email at office@idahotreesmiths.com or by phone or text at 208-274-3003, except that the Customer remains responsible for any authorized expenses already incurred, meaning costs we have paid or committed to for the approved work, such as equipment rental, disposal fees, permit fees, and specially ordered materials. If the Customer cancels less than 24 hours before the start, we may add a $50 cancellation fee to the invoice, plus any authorized expenses already incurred.

After work begins. Once our crew begins work at the property, the Customer is responsible for the full price stated in the quote.

12. Service Concerns and Refunds

Completed tree work cannot be returned and is generally nonrefundable. If the Customer believes the approved scope was not completed or has a workmanship concern, please contact us in writing (email or text is fine), with photos if possible, within seven calendar days of completion. Please give us a reasonable opportunity to inspect before the work is altered. We will review the concern and, when appropriate, correct the work at no additional charge. Refunds are not ordinarily provided for changes in aesthetic preference, normal changes in a tree’s appearance after trimming, conditions outside our control, or services not included in the approved quote. Duplicate payments, overpayments, and confirmed billing errors will be refunded in full, to the original payment method, within 10 business days of confirmation.

13. Insurance

We carry general liability insurance. A certificate of insurance is available on request.

14. Electronic Acceptance and Records

Selecting "Accept" electronically is the legal equivalent of a handwritten signature, and we may deliver quotes, invoices, change approvals, and notices by email or text.

15. General Terms

Reasonable Care. "Reasonable Care" means the level of care a reasonably careful and qualified tree-service professional would use under similar circumstances. Where these Terms limit our responsibility for damage, the limitation does not apply to damage caused by our failure to use Reasonable Care.

  • Working through concerns. If something doesn’t meet your expectations, or a disagreement comes up, please contact us first at office@idahotreesmiths.com or 208-274-3003. We want to hear about it and will work with you toward a fair resolution.
  • Governing law. These Terms are governed by Idaho law.
  • Severability. If any part of these Terms is unenforceable, the rest remains in effect.
  • Entire agreement. The quote and these Terms are the entire agreement for the work described and replace any earlier discussions or estimates. Changes must be approved as described in Section 3.
  • Legal rights. Nothing in these Terms limits rights provided by applicable law.
